Defendant was served by plaintiff on Saturday 04 March 2006, in Humboldt County, but immediately left Humboldt County for San Francisco County, taking the legal materials with him.

Defendant was overwhelmed by the abundance of legal materials (87 pages, many of them printed on both sides) and was unable to absorb it within 72 hours.

Defendant's capacity to absorb these materials was interrupted by defendant's car spinning out in the rain, going off of Highway 101, into an embankment, and into a ditch, late on the evening of 08 March 2006 (Exhibit 3, California Highway Patrol Collision Report Information, dated 08 March 2006).

Defendant only became aware of his legal obligation to turn in his firearms on Thursday, 16 March 2006.

Defendant's firearms are all located in Humboldt County, 300 miles away.

Defendant does not anticipate being in Humboldt County until after the hearing, on 22 March 2006, due to extreme poverty, and the cost of fuel.

Defendant will turn in his firearms within 72 hours of returning to Humboldt County.
